Halloween is almost over and we hope it was fun, safe, and spooky for all the kiddos! I love seeing all the costumes and the houses decorated for this very favorite holiday.

Now it’s time to get down to the importance of literacy and your vote.

According to U.S. Code §10508, any voter who requires assistance to vote because of blindness, disability, or inability to read or write may be assisted by a person of the voter’s choice, other than the voter’s employer or agent of that employer or officer or agent of the voter’s union. Yet with redistricting and the numerous new State laws targeting people of color and other minorities, voting for people who struggle to read is challenging. According to ProLiteracy, more than 35 million adults in the United States cannot read, write, or do basic math above a third-grade level. An estimated 63 million adults only read between a sixth and with grade level. Children of those parents have a 72% chance of being at the lowest reading levels themselves. Parents are our first teachers.

Understanding a ballot is difficult when one is a proficient reader as many of the statements are confusing. When a person has low or no literacy skills, knowledgeable voting is almost impossible. Some states have required those who need help to sign an affidavit explaining why they need assistance. Other states do not allow voters to bring sample ballots to the polls and some states limit the number of voters a volunteer may assist. Even when federal courts strike down these restrictions, states create more obstacles.

Voter suppression is real, yet voting is a right of all Americans. The cost of illiteracy to American taxpayers has climbed to $250 billion a year. When someone can’t read, they are excluded from innumerable activities that allow them to function as a human or to reach a level of success. Many are forced to live in poverty. Our prisons are filled with illiterate inmates.

The midterm elections are upon us. Carefully read the sample ballots and if you know someone who has difficulty reading, read the information to them.

Although our young children cannot vote, READ to them daily. Reading to kids early on can help to boost literacy rates over the long term. An estimated 77% of children who are read to are more likely to read or attempt to read on their own, versus 57% of kids who don’t have regular story time at home. Growing up in a literacy-rich environment will one day enable them to be voters who understand what’s on the ballot.

In California, one proposition on the ballot that is not contested is Proposition 28 which will provide the arts to our students. As a mom, actor, author, artist, and coach, I’m asking you to Vote YES on California Proposition 28 on the November 8 ballot. If passed, Proposition 28 will funnel nearly $1 billion annually in new funding to arts and music education in our PreK-12 public schools. All without raising taxes!

A well-rounded education might start with language and math, science and history. But it is not complete without the arts, and on that score, too many California schoolchildren are getting shortchanged.

When the state budgets get tight, arts and music programs are often the first to go. As a result, barely 1 in 5 California elementary schools have full-time art and music program.

Children deserve an opportunity to discover and develop their creative talents. Plus, research shows that students in art classes tend to do better in other subjects and are less likely to miss school. Arts education also correlates to better mental and physical well-being.

For the adults reading this newsletter, remember your vote matters. The political environment has been especially hostile, negative, and violent this season. Study the reference guide to familiarize yourself with the ballot. Vote for the people, policies, and programs that will create a better environment for our nation, our states, and our communities, as well as for you.

What Can I Do If My Dependent Was Claimed on Another Tax Return?

Several times during tax season we electronically file a client’s tax return, only to learn that one of the client’s legal dependents was claimed falsely on another tax return. Sometimes this is due to identity theft, which will be discussed in another blog. More often this situation arises because an ex-spouse, a grandparent, or another ineligible family member has the child’s information and claims the child, even though they did not have the child for at least 6 months or provide 50% or more of the child’s support. Unfortunately, many tax preparers simply tell their clients that there is nothing that can be done since the child has already been claimed. Such a statement is wrong and misleading, because there are procedures we can take that will allow you to get the tax credits you deserve as the custodial parent.

How can you get the tax credits for your qualified child? When the taxpayer enters our office or schedules a video conference with this problem we discuss with them how the problem can be fixed. We suggest the taxpayer gather documents that support their claiming the child. Once these documents are gathered, we attach the documents to the prepared tax return. We have the taxpayer then mail the tax return to the proper IRS office.

In about 6 to 8 weeks the taxpayer receives their refund from the IRS. Occasionally, the IRS may request additional documents to support your claiming the child. The IRS then will allow your claiming the child and give you the tax credits. Then the IRS will contact the taxpayer who falsely claimed the child and request payment back of any tax benefits received from claiming a child they were not eligible to claim.

There is no race to see who can claim the child first. The tax law plainly states that the qualified taxpayer is the party that can properly and legally claim a child on a tax return.

Many tax preparers misinterpret court orders and tax law when preparing tax returns. Since 2009 the IRS has taken the position that a county court cannot tell the IRS how exemptions are claimed on a tax return. Attaching copies of a divorce decree are not sufficient to claim the exemption on a child who does not live with you.

Basicly, the parent who has the child in their home for more than half the year and provides 50% or more of the support (this does not include child support) is the parent that can claim the child as a dependent. The dependency can be released to the noncustodial parent if the custodial parent signs form 8332. The noncustodial parent must then attached form 8332 to his tax return. If you are a noncustodial parent, make sure to have the custodial parent sign 8332. If form 8332 is not attached to your return, it can cost you later.

One area where I commonly see mistakes for custodial parents is with the Earned Income Tax Credit (EITC). The noncustodial parent is not eligible to claim the EITC, since their child did not reside in their home 6 months or more. Even if the child dependency is released to the noncustodial parent, the custodial parent is eligible to claim EITC if they have earned income. The custodial parent may even be eligible to claim head-of-household filing status. In cases where the parents have joint custody, there are many factors that the tax preparer has to examine before determining who is eligible for the EITC.

I always request a copy of the court documents.

People often ask me what exactly is a life altering event? I tell them this – It can be something we choose or something that is thrust upon us that dramatically alters the trajectory of our life.

Latachia is the author of the book Life Derailed, A Divorced Mom’s Survival Guide. Her inspiration to write this book was to recover from a very traumatic divorce and let other women and men know they are not alone. Latachia addresses that your emotions, feelings, grief, sense of loss, how will I pay my bills, fear of the future are not unique. If you have not read this book – do it today!

Latachia is also a public speaker, writer, and entrepreneur. Her passion is to motivate and inspire women, especially women with children impacted by divorce. Being in an abusive relationship is a life altering and divorce can be terrifying and debilitating but which is worse? She equips women to find their independence and strength, learning how to find their voice and love themselves first.

Now men, don’t see this title and think “This is a chick book.” It’s not. Latachia provides a common sense approach at time when common sense is often absent. This common sense applies equally to both men and women.

One powerful piece of advice from her book is:

In dealing with the sorrow of divorce or a major loss in your life/family, take one breath at a time, make one decision at a time, and focus on just the current day and what you can achieve. The saddest thing for a child is to be in your presence and you not really being there. Be in the moment, embrace them. You control more in life when you don’t let the issues, things control you.

Another statement she wrote that I loved and wish I had followed is “Stop Saying you are OK.”

Stop saying you’re OK. Seriously, it’s OK to not be OK. Wait till the kids are away and SCREAM, cry and then get out a piece of paper and write it all down, random thoughts, fears and ideas. Get it out, it’s OK, you have a right to be in this place.

Remember divorce is a legal process. It is a legal process to become married and a legal process to end the marriage. It is a huge mistake to rush through the process or say to your ex “Just get the papers and I’ll sign so we can get this over.” Don’t ignore this step. There are too many important issues regarding finances, property and most importantly the needs of your children. Get it in writing up front because promises made prior to divorce often change afterwards. The children certainly don’t need to re-live these battles over and over.

Another major issue you will likely face is “the call” from your ex, suggesting you try again. Stop! Proceed with caution. Think about why things will be better or different if you jump back in. Really stop and think about it or you may find yourself in a worse situation in the next year or two. Why is your ex asking to get back together when they were so eager to leave?

Picking up the pieces is not easy. It will be the most difficult thing you will ever do, but keep this in mind, stop looking behind you, you’re not going that way. There is nothing new to see in the past so keep moving forward. Believe it or not, better times and better people will come into your life.

Holistic and alternative schools, and education methods, can only partly meet the needs of the ‘Children of the New Age’. Many children feel misunderstood, and react with emotional or physical problems, which can’t be dealt with and solved by traditional methods.

Classical education and the school system still focus on a child’s mental ability. Alternative schools also include the physical and emotional level in their education system. But there is still one area missing, which has never been taken into account so far: the support and care for the spiritual-energetic level of young people – the spiritual education.
Ingrid Auer’s project, wants to provide interested parents, teachers and therapists, with practical and easy tips and instructions. Her spiritual tools – energized symbols and essences – support and accompany children effectively.

Although the origins of our tools are in the spiritual level of our being, the application is independent of any religious or ideal values. No matter what world view you identify with, the effect of the tools is the same. It requires a certain amount of openness for new and so far unknown dimensions of our human life.

Tune in for a new episode “Parental Wellness: The Importance of Boundaries and Keeping Them” on Moving Forward: Wellness One Step at a Time on Friday June 27th at 1 PM Pacific Time on VoiceAmerica Health and Wellness Channel.

Join us as we talk with Dr. Karla Steingraber about effective parental wellness. Dr. Steingraber works with parents and children, in and out of the foster care system, since many years, in a variety of settings and states,  and specializes in parenting strategies. She will discuss parental boundaries, what these are, why they are important, how they contribute to family wellness and steps listeners can take to move forward in creating their own boundaries and parental wellness.

Karla Steingraber Guest Bio:

Karla Steingraber, Psy.D. is a licensed clinical psychologist who loves helping parents regain their confidence in effective parenting and children with finding a healthy equilibrium between natural rambunctiousness and respecting limits.  She spent time working in clinics, hospitals and residential programs in DC, Wyoming, Illinois and Montreal, Canada, working intensely with foster parents and children of all ages, developmentally delayed individuals and those with a brain injury, amongst other populations.  These experiences, as well as that of being a parent, have shaped her understanding of impulse control and the necessity of clear boundaries.

This show is about creating wellness, one step at a time. It’s about being curious and seeing what happens with doing something different, being different, or embracing what is different. It’s about cultivating possibilities and creating a rippling effect of change. It is about being the change one wants to see. We provide straightforward information and steps for you to try. The show provides the encouragement and nonjudgmental space to try something that is going to help you move forward.Resources may also be available.This program will cover topics relating to all areas of wellness, including physical, mental, emotional, sexual, financial, spiritual, social and behavioral areas. Moving Forward: Wellness One Step at a Time is broadcast live every Friday at 1 PM Pacific Time on the VoiceAmerica Health and Wellness Channel.
